Immigrant Worker Petition

An I-140 is the petition for an immigrant worker. The filing of this petition is required to first determine the eligibility for classifying a foreign national as someone who may apply for an employment-based immigrant visa at a consulate overseas or apply for adjustment in the U.S under an employment-based preference category.

Most, but not all, employment-based immigration petitions will first require a labor certification (PERM). In such cases, if a labor certification by the U.S. Department of Labor is not submitted with the I-140 Petition to the U.S. Citizenship and Immigration Services (USCIS), the I-140 will be denied; however, there are limited exceptions.
